🛡️ Maryland Registration Requirements for Structured Settlement Transferees

In Maryland, companies that acquire structured settlement payment rights must register with the Office of the Attorney General’s Consumer Protection Division. This requirement ensures transparency and oversight of all structured settlement transfers filed in Maryland courts.

Legal Basis

Registration is required under Md. Code Ann., Cts. & Jud. Proc. § 5-1107 and § 5-1108. No transferee may file a petition to transfer structured settlement payment rights in Maryland without first being registered.


Initial Registration Requirements

To register as a Structured Settlement Transferee in Maryland, the applicant must:

  • Submit a completed registration application
  • Pay a nonrefundable $2,000 fee (check or money order payable to the Office of the Attorney General)
  • Answer all questions completely, including disclosures about:
    • Legal structure and ownership
    • Control affiliates and corporate relationships
    • Prior Maryland transaction activity
    • Legal proceedings or regulatory complaints
  • Identify responsible managers and Maryland domain activity
  • Report any assistance provided in establishing payee residency
  • Provide a spreadsheet of all Maryland petitions filed since 2015, including:
    • Case number, filing date, discount rate, and authorization status
    • Use of independent professional advisors

The registration is valid for one year from the date of approval and must be renewed annually.

Applicants must disclose:

  • Civil or regulatory findings of dishonesty
  • Consumer complaints
  • Unresolved judgments, tax liens, or bankruptcies
  • Convictions related to fraud or moral turpitude
  • Any manipulation of payee residency status for forum shopping purposes
